Terms of Service

These Terms of Service ("Terms") are an agreement between you and Scoops Dev LLC, a Vermont limited liability company ("Scoops Dev", "we", "us"), and govern your use of Wockett ("the App"), a walking app that suggests routes, tracks walks, counts steps and keeps profiles for the pets who come along. Wockett was previously published under its developer's personal name; Scoops Dev LLC is now its publisher and the party to these Terms. By downloading, installing or using Wockett, you agree to these Terms. If you do not agree, do not use the App.

1. Who Can Use Wockett

Wockett is not directed at children under 13, and you must be at least 13 to use it. If you are under 18, you may use Wockett only with the permission of a parent or guardian who agrees to these Terms for you.

2. Walk Safely — Routes Are Suggestions

Route suggestions, directions, trail information, distances, elevation, weather and arrival estimates are generated automatically from map and third-party data. They can be wrong, out of date or unsuitable for walking — for example, a road without a sidewalk, a closed or private path, unsafe terrain, or a place where pets are not allowed.

• You are solely responsible for your own safety and that of anyone and any animal with you. Use your own judgment, watch where you are going rather than your screen, obey traffic laws, signs and closures, and do not enter private property without permission.
• You are responsible for your pets, including following leash, licensing and clean-up rules and judging whether a route, the weather or the distance suits them.
• Check conditions before you go. Weather and elevation data are provided for convenience and should not be your basis for safety decisions.

3. Health Information Is Not Medical Advice

Wockett can show steps, distance, calories, heart rate figures, sleep, walking steadiness and gait measurements, and other figures from Apple Health. These are for general information and motivation only. Wockett is not a medical device, does not diagnose, treat or prevent any condition, and is not a substitute for advice from a doctor or other qualified professional. Wockett is not an emergency or safety tool and cannot call for help. Talk to a doctor before starting a new exercise routine, and stop and seek help if you feel unwell. Never ignore or delay professional medical advice because of something you saw in the App.

4. Your Data

Wockett is local-first: your walks and settings are stored on your device and synced through your own private iCloud account. We do not operate servers that receive this data, and we cannot access it. Full details are in our Privacy Policy, which is part of these Terms.

5. Community Content

Wockett lets you choose to publish routes, challenge entries and feed posts ("Community Content") that other Wockett users can see.

• You own your Community Content. By publishing it, you give Scoops Dev a worldwide, non-exclusive, royalty-free licence to host, store, display, distribute, reformat and moderate it within the App for as long as it remains published. Copies other users have already saved, such as a route they added to their own list, may remain with them after you remove it.
• Think before you share. A shared route can reveal where you start and finish — for example, near your home. Published content is visible to other users. To have content you published removed, email support@wockett.app. From version 1.16 of the App, you can also delete your own routes, feed posts and challenge entries in the App: long-press one and choose Delete from Community, and it is removed for everyone. From that version, a challenge you created is deleted the same way while nobody else has joined it; once others have, deleting it would also remove their progress, so the App sends us a request to delete it instead.
• No objectionable content or abusive users. You may not publish anything unlawful, hateful, harassing, threatening, sexually explicit, violent, defamatory, misleading or infringing, anything that reveals another person's private information (including where they live), or anything that encourages unsafe activity. There is no tolerance for objectionable content or abusive behaviour.
• Reporting and blocking. Reporting content or blocking a user in the App hides it from you right away. In version 1.14 a report is not sent to us; email support@wockett.app to bring content to our attention. From version 1.15, the App also opens an email report to support@wockett.app for you to send. From version 1.16, a report reaches Scoops Dev directly: the App sends it to us with the reason you choose and any note you add, and we review it; if the App cannot send it, it offers to email the report instead. Blocking a user is not sent to us. We may remove any Community Content, or suspend a user's access to Community Content features for a time or permanently, at our discretion and without notice.
• Use other people's routes at your own risk. Routes shared by other users are not checked by us, and section 2 applies to them.
• Copyright complaints. If you believe Community Content infringes your copyright, email support@wockett.app with the content, your work, and your contact details, and we will review it.

6. Purchases

• Tips are voluntary, one-off payments to support development. They do not unlock features, and there is nothing to restore on a new device. Tips are the only purchase in the App.
• Tips are processed and billed by Apple through the App Store. We never see your payment details. Refund requests are handled by Apple under its policies (reportaproblem.apple.com).

7. Third-Party Services

Wockett relies on Apple services (Maps, WeatherKit, HealthKit, iCloud) and on OpenTopoData for elevation. These are operated independently of us, and we do not control their accuracy, availability or uptime.

8. Acceptable Use

You agree not to use Wockett for any unlawful purpose, to interfere with or disrupt the App or other users, to reverse engineer it except where the law allows, or to misuse Community Content features.

9. Intellectual Property

Wockett, its name, design and underlying code are owned by Scoops Dev LLC and protected by applicable intellectual property laws. These Terms grant you a personal, non-transferable, revocable licence to use the App; they do not give you any ownership in it. Your own data and Community Content remain yours.

10. Disclaimer of Warranties

Wockett is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any route, map, trail, weather, elevation, health or step data will be accurate, complete or safe to rely on.

11. Limitation of Liability

To the fullest extent permitted by law, Scoops Dev LLC and its members are not liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury, illness, injury to or loss of a pet, property damage or lost data, arising from your use of, or inability to use, Wockett — including following a route, relying on health figures, or using Community Content. Our total liability for any claim arising from your use of the App is limited to the amount you paid us through the App in the twelve months before the claim, or $50, whichever is greater. Some places do not allow some of these limits, so they may not all apply to you.

12. Indemnification

You agree to indemnify and hold Scoops Dev LLC and its members harmless from any claims, damages or expenses (including reasonable legal fees) arising from your use of Wockett, your Community Content, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

You may stop using Wockett at any time by deleting it. We may suspend or end your access to Community Content features, or to the App, if you violate these Terms. Because your data lives in your own private iCloud account, deleting the App does not itself delete data already synced there; you control that through iOS Settings.

14. Apple App Store Terms

You acknowledge that these Terms are between you and Scoops Dev only, not Apple Inc. ("Apple"), and that Scoops Dev, not Apple, is solely responsible for Wockett and its content. Your licence to use Wockett is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple has no obligation to provide maintenance or support for Wockett. If Wockett fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for Wockett. Scoops Dev, not Apple, is responsible for addressing any claims relating to Wockett or your use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that it infringes a third party's intellectual property; Scoops Dev, not Apple, is solely responsible for the investigation, defense, settlement and discharge of any such intellectual property claim. You must comply with any applicable third-party terms (such as your wireless data service agreement) when using Wockett. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App after changes are posted means you accept the updated Terms.

16. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Scoops Dev about Wockett. If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. Scoops Dev may assign these Terms, for example to a successor business.

17. Governing Law

These Terms are governed by the laws of the State of Vermont and applicable United States federal law, without regard to conflict-of-law principles.
